TL;DR (not a substitute for the Terms). This document governs the free intake (≈45 minutes) only. Currently, any follow-ups we may agree during the intake are also provided free of charge and remain under these Terms. If we ever offer paid services, those will be governed by a separate Engagement Agreement (see Order of precedence) and the Switch-to-Paid Appendix below. Coaching/education only—not therapy, medical, legal, or financial advice; no guarantees of outcomes. Default delivery is Google Meet; short-notice bookings allowed; each party may reschedule once for short-notice bookings with ≥1h notice. Two unannounced no-shows (notified <1h) may end the intake engagement. No recordings by either party without mutual written consent. We respect confidentiality with standard safeguarding exceptions. Liability is reasonably capped.

1) Scope & audience

  • Adult coaching (18+) limited to the intake session (≈ 45 minutes).
  • We provide coaching/education—not therapy, medical/psychological, financial, or legal advice. No diagnosis/treatment and no guaranteed outcomes.
  • You retain full responsibility for your own decisions, actions, and well-being. You agree to seek independent professional advice for medical, legal, or financial matters where appropriate.
  • We may decline topics at our discretion and signpost alternatives.

2) Scheduling & delivery

  • Tool: Notion Calendar; times shown in Europe/Amsterdam.
  • Delivery: default Google Meet; in person by mutual agreement/location.
  • Short-notice bookings: you may book within 4 hours of start when slots are available.
  • Lateness: we wait 15 minutes; the session still ends on time.
  • Between booking & intake: standard channel email; typical reply within 48h on business days.

2A) Pre-contract information & confirmation

Before you book, we display key information for distance services (our identity and contact, main features, price €0, scheduling rules, and how to cancel). At sign-up you accept these Terms and acknowledge the Privacy Notice. After booking, we send an email confirmation that includes or links to these Terms and the Privacy Notice on a durable medium (you can store/print).

3) Rescheduling, cancellations & no-shows

Definitions

  • “Short-notice booking” = appointment booked <24h before start.
  • “No-show” = you cancel <24h before start or do not attend.

Client side

  • Reschedule/cancel ≥24h: allowed, no penalty.
  • Late cancel/no-show (<24h): counts as one no-show (unless emergency).
  • Two no-shows (where notice was <1h before start) → we may end this intake engagement.

Coach side

  • We aim to give ≥24h notice if we must reschedule.
  • Short-notice symmetry: for short-notice bookings (<24h), each party may reschedule once on reasonable grounds with ≥1h notice, without penalty. After each side has used (or waived) their one reschedule, the regular no-show rule applies.

4) Fees

  • Free: the intake is €0.
  • Follow-ups: if we both agree to continue after the intake, those follow-up sessions are currently free of charge but are governed by the Free Follow-Up Engagement Agreement (FFEA) provided after the intake. If we later offer paid coaching, paid services will be governed by a Paid Engagement Agreement and by the Switch-to-Paid Appendix.

5) Cancellation Policy & Consumer Rights (Free Service)

This intake is provided free of charge (€0). You may cancel at any time subject to §3 (scheduling rules). The EU right of withdrawal rules for consumer contracts generally do not result in any refund in the context of a free single appointment; there is no ongoing paid service from which to withdraw. If the intake or follow-ups become paid in future, we will provide the required pre-contract information and withdrawal details before you book and confirm them by email.

6) Privacy & confidentiality

  • We handle personal data per our Privacy Notice (linked wherever we collect data). Typical processors include MailerLite, Notion, Google Meet, and our email provider.
  • Confidentiality applies to session content except where disclosure is reasonably needed to: (a) prevent serious harm; (b) report abuse of minors/vulnerable persons; (c) comply with law/court order; or (d) obtain professional supervision using de-identified details.
  • Recordings: no recordings by either party unless both give prior written consent; if consented, we restate consent on record at the start.

7) Inclusion, accessibility & conduct

  • We aim for an inclusive, harassment-free experience and will make reasonable accommodations where feasible—please email requests in advance.
  • No harassment, discrimination, illegal activity, or recording without permission. We may pause/terminate a session for misconduct.
  • Client warranties: you are 18+, not in an acute crisis, and understand this is coaching/education, not therapy. If you are in crisis, use local emergency services.

8) Intellectual property

  • Any intake materials/frameworks remain our IP. We grant you a personal, non-transferable licence for your own use. No redistribution without permission.

9) Liability

As the intake is free of charge, our liability is appropriately limited. We provide services with reasonable skill and care but do not guarantee outcomes.

  • Cap: €250 per claim; €500 aggregate relating to the intake.
  • Exclusions: no liability for indirect or consequential loss, business loss, or force majeure.
  • Carve-outs: nothing limits liability where unlawful to do so, including death or personal injury, fraud/fraudulent misrepresentation, or intent (opzet) / gross negligence (grove schuld).
  • Your statutory consumer rights remain unaffected.

10) Changes, disputes & boilerplate

  • Updates: We may update these Terms (intake only)
  • Complaints: niklas@transformational-u.com — we aim to resolve issues amicably.
  • Governing law: Dutch law, without prejudice to any mandatory consumer protections of your EEA country of residence.
  • Jurisdiction: disputes may be brought in the courts of Maastricht (NL) or in the courts of your domicile (if you are an EEA consumer) under consumer forum rules (Brussels I bis).
  • Third-party tools: We may use third-party tools (e.g., Google Meet, Notion, MailerLite, email providers). Each has its own terms. We are not responsible for their outages or changes, but we choose reputable providers and protect your data as described in our Privacy Notice.
  • Subcontractors: we may engage guest coaches; we remain responsible.
  • Order of precedence: For free follow-ups, the Free Follow-Up Engagement Agreement (FFEA) applies alongside this intake ToS; in case of conflict, the FFEA prevails for the follow-up phase. For any paid coaching, the Paid Engagement Agreement prevails over both.
  • Entire agreement / severability / no waiver / e-signatures & notices: standard terms apply. Notices by email are deemed received next business day.
